Amicable debt collection on behalf of third parties falls, in particular, within the framework of Articles R.124-1 et seq. of the French Code of Civil Enforcement Procedures, subject to the conditions applicable to each matter.
LEGATUM & PARTNERS carries out debt recovery activity on behalf of its clients, under mandates and agreements entered into with them. The firm intervenes in amicable recovery, pre-litigation and the strategic steering of judicial matters linked to B2B receivables. In this respect, it may analyse documents, structure evidence, prepare litigation files, draft documents, arguments, exhibit schedules and materials transmitted to authorised professionals. Where the intervention of a lawyer, enforcement officer or another regulated professional is required, in particular to file, sign, serve, enforce or plead an act, that intervention is coordinated by the firm in connection with the client and the professional concerned.
Limits of intervention
LEGATUM & PARTNERS’ services are performed within the framework of mandates, agreements or arrangements entered into with its clients. The firm acts as a debt recovery professional and as the creditor’s strategic interlocutor, in particular for document analysis, evidence structuring, reminders, negotiation, pre-litigation preparation, case monitoring, preparation of litigation files, draft submissions, arguments, exhibit schedules and materials transmitted to authorised professionals where their intervention is required.
Where proceedings require mandatory representation or where an act falls within a regulated profession, in particular representation in court, filing of submissions by a lawyer, pleadings, service or compulsory enforcement, LEGATUM & PARTNERS coordinates the intervention of authorised professionals in connection with the client. The firm may prepare the file, draft documents and litigation strategy, while acts subject to mandatory representation are filed, signed or pleaded by authorised professionals where required by law.
LEGATUM & PARTNERS does not carry out direct recovery against private individuals. Services relating to B2C companies are limited to advisory support, internal organisation, process structuring, steering tools or administrative assistance.
